Legal Notice

This page describes the terms and conditions governing the use of this website (hereinafter the "Site").
By visiting the Site you unconditionally undertake to comply with these terms and conditions.
As terms and conditions may be amended at any time, without prior notice, we advise you to consult them regularly.

1. Intellectual property
The Site belongs to and is operated by HealthOne Pty Ltd, (hereinafter “HealthOne”). The layout and each of the components, including trademarks, logos and domain names, appearing on the Site, are protected by current laws on intellectual property, and belong to HealthOne, or their use is the subject of an authorisation from the registered trademark owner.
No component of the Site may be copied, reproduced, altered, edited, downloaded, denatured, transmitted or distributed in any way whatsoever, on any medium whatsoever, in whole or in part, without the prior written consent of HealthOne. Only copying for private use is authorised for your own personal, private, non-commercial use, on your personal computer. HealthOne reserves the right to take legal action against any breach of its intellectual property rights.

2. Nature of information
The Site may offer opinions by experts consulted in a particular field in relation to the content of the Site or excerpts from press articles. Any such information solely represents the opinion of the expert consulted or the publication, and is not necessarily the opinion of the HealthOne. Any such experts are not employees of the HealthOne and do not receive any emoluments in exchange for HealthOne using their opinion. HealthOne is not responsible for the accuracy or completeness of any such information and opinions. Experts’ opinions reflect their own personal views and should never be interpreted as being the opinion or responsibility of HealthOne.

3. Links to other sites
The liability of HealthOne shall not be incurred by a third party site that can be accessed via the Site. We do not have any way of controlling the content of such third party sites which remain entirely independent of HealthOne. Moreover, the existence of a link between the Site and a third party site does not under any circumstances mean that HealthOne approves the content of that site in any way whatsoever and in particular the use that may be made of it. In addition, you are responsible for taking the precautions necessary to prevent any infection from the Site, in particular by one or more computer viruses, Trojan horses or any other "parasite". External sites may include hypertext links to the Site. Any such links should not be created without the express prior consent of HealthOne. In any case, HealthOne is not in any way liable for the non-availability of such sites and HealthOne does not scrutinise, check or approve them and is not responsible for contents, advertising, products or other components available on or via those sites.

4. Personal information and other information

4.1 HealthOne will not disclose to third parties personal data about you that you may convey to it by e-mail. It will only be used with a view to providing you with an answer as effectively as possible. 4.2 The Site is not intended to receive confidential information from you. Consequently, and except for personal data mentioned above, any information, whatever its form - document, data, graphic, question, suggestion, concept, comment or other - that you send us via the Site, will not under any circumstances be deemed confidential. Consequently, the act of sending it to us alone gives us the right to use it, reproduce it, publish it, alter it or send it with a view to dealing with your request.

5. Limitations on liability

HealthOne strives to the best of its ability to ensure that information published on the Site is accurate and up-to-date. It reserves the right to correct content at any time, without prior notice. However, HealthOne cannot guarantee that the information available on the Site is accurate, correct, up-to-date or complete. Consequently, and except for property damage resulting from gross or intentional negligence by HealthOne, the latter declines any liability: for any inaccuracy, error or omission as regards information available on the Site; for any damage resulting from fraudulent intrusion by a third party resulting in an alteration of information or items made available on the Site and more broadly, for any property damage or consequential loss, for any reason, of any origin, nature or with any consequences whatsoever, even if HealthOne had been warned of the possibility of such damage or loss, caused (i) because of any access to the Site or because it was impossible to access it, (ii) because of the use of the Site, including any harm or virus that may infect your computer or any other property, and/or (iii) because of the credence given to any information coming directly or indirectly from the Site. The components of the Site or of any other site are provided "as is" without any guarantee of any kind, whether implicit or explicit. HealthOne does not offer any implicit or explicit guarantee, relative, without limitation, to their market value or suitability for any given purpose.

6. Availability of the web site

You acknowledge (i) that it is technically impossible to provide the Site free from any defect and that HealthOne cannot undertake to do so; (ii) that defects may lead to the Site being temporarily unavailable; and that (iii) operation of the Site can be affected by events and/or matters that HealthOne does not control, such, for example, as means of transmission and communication between you and HealthOne and between HealthOne and other networks. HealthOne and/or its suppliers may, at any time, alter or interrupt, temporarily or permanently, all or part of the Site to undertake maintenance and/or make improvements and/or changes to the Site. HealthOne is not responsible for any alteration, suspension or interruption of the Site.

PRIVACY POLICY

HealthOne is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) for Australia as well as the Privacy Principles contained in the Privacy Act 1993 for New Zealand (together referred to as the “Principles”). The Principles define personal information as information or an opinion relating to an individual which can be used to identify that individual (such as name, address, telephone number, email address), and are designed to protect the confidentiality of personal information and the privacy of individuals by regulating the way personal information is managed.

HealthOne recognises the importance of your privacy and understands that the security of your personal information is important to you. We are committed to protecting the personal information you provide to us. This privacy policy outlines how we generally manage your personal information and protect your privacy. This privacy policy (“Privacy Policy” or “Policy”) does not apply to third party on-line resources to which HealthOne’s website might be linked where HealthOne does not control the privacy practices of such resources. However, HealthOne will endeavour to link to on-line resources that are known to abide by the Principles.

1. Why does HealthOne collect personal information?
HealthOne is a leading Australian Healthcare company, providing solutions and services for other businesses operating within this space. As a matter of conducting its routine business, HealthOne may collect the following types of personal information:

a. Healthcare Professionals and their Employees
HealthOne collects personal information about healthcare professionals and their employees or assistants, such as Dentists and Hygienists

b. Websites
When you look at a HealthOne operated website, our Internet Service Provider makes a record of your visit and logs the following information for statistical purposes:

  • your server address;
  • your top level domain name (for example .com, .gov, .au, .uk etc);
  • the pages you accessed and documents downloaded;
  • the previous site you have visited; and
  • the type of browser you are using.

HealthOne will not make an attempt to identify users or their browsing activities. However, in the unlikely event of an investigation, a law enforcement agency or other government agency may exercise its legal authority to inspect our Internet Service Provider's logs.

Your e-mail address will only be used or disclosed for the purpose for which you have provided it and it will not be used or disclosed for any other purpose without your consent.

Google Analytics Demographics and Interest Reporting have been enabled on some HealthOne operated websites and as a result personal information about users such as age, gender and interests may be collected. Such information will only be used or disclosed for the purpose of better understanding users and identify how experience and interaction can be improved and will not be used or disclosed for any other purpose without your consent.

2. How does HealthOne use personal information and to whom may HealthOne disclose it?
The Principles generally require HealthOne to use personal information only for the primary purpose for which it is collected, or for secondary purposes that are related to the primary purpose. In general, HealthOne uses personal information for the following purposes:

  • to promote and market HealthOne or HealthOne client’s products and services;
  • to provide information on health related products or services that have been requested;
  • to comply with legal obligations.

Generally, we require that organisations outside HealthOne who handle or obtain personal information as service providers to HealthOne acknowledge the confidentiality of this information, undertake to respect an individual’s right to privacy and comply with the Principles and this Policy.

3. Sensitive information is subject to greater restrictions
The Principles require that sensitive information is used and disclosed only for the purposes for which it was provided, or a directly related secondary purpose, unless you agree otherwise or for other specific reasons such as if the use or disclosure of this information is required by law or to prevent a serious and imminent threat to life or health of an individual. The nature of HealthOne activities does not involve the collection of sensitive information in the ordinary course of conduct.

4. Spam

HealthOne’s interactions with you are also regulated by the Spam Act 2003 in Australia and the Unsolicited Electronic Messages Act 2007 in New Zealand. In compliance with these Acts, HealthOne will not send you a commercial electronic message to you unless permitted. Some of HealthOne programs are subscription based which include the transmission of email communication to you for which your consent is requested.

5. Management and security of personal information
HealthOne has appointed a Privacy Officer to oversee HealthOne management of personal information in accordance with this Policy and the Principles. All data that is collected is held electronically on password protected systems. Personal information is only accessible by persons that require access to that information to carry out their work. HealthOne has directed its staff that personal information must be dealt with in accordance with this Policy and kept secure from unauthorised access or disclosure.

9. How to complain about a privacy breach and how will HealthOne deal with such a complaint?
If you believe that HealthOne has breached the Principles you may complain in writing to our Privacy Officer (see contact details below). HealthOne will respond within thirty (30) days and will use its best endeavour to resolve the issue.
